1. General Terms of Service
The present provisions regulate the use of the service of the website onparle.net, onparle.co, salledeclasse.online and other sites or applications (hereinafter, the "Website") owned by Onparle SAS identified with NIT 901057632-9, domiciled at CLL 27 Sur#28-56, Envigado, Antioquia, Colombia, Phone:(+57) 4 601 71 67 and 310 242 7646 hereinafter, (Onparle, the "Company", "we", "us" or "us") makes available to Internet users, subject to these terms and conditions (the "Terms of Service") and Onparle's corresponding Privacy Policy (the "Privacy Policy."). If you do not agree to the Terms of Service or the Privacy Policy, do not use the Service.
For your convenience, these terms are available in English and in the event of any conflict the English version shall be final.
The Company owns and operates the Website. We offer you the ability to learn French through our online services and site functionality, as well as offline through our digital content on or off the Website (collectively, the "Service"). The Service includes access to the platform, Courses, Online Classes and digital content, which are managed by the Company.
This right of use is limited to you, for your individual use (not as a partnership, business or corporate entity), which is non-transferable unless expressly consented to in writing by the Company.
Access to the Web Site is free of charge except for the cost of the connection through the telecommunications network provided by the access provider contracted by the users. Certain services are exclusive for our customers and their access is restricted. The services provided by OnParle in general, have the price indicated in the corresponding commercial offer, are offered or provided through the service of the Web Site and third party platforms as is the case of some of our virtual classes.
Legal information and acceptance
You must be at least 18 years of age to agree to these Terms of Service, provided, however, that if you are under 18, your parent or legal guardian may agree to them on your behalf. By using the Service, you consent to the collection, processing and use of all information related to your use of the Service, which is collected and handled in accordance with the terms of our Privacy Policy. You understand that you may encounter content that you find objectionable. We reserve the right, at our discretion, to change these Terms of Service at any time, without notice. In the event of any material change, we will use commercially reasonable efforts to notify you and obtain your consent prior to implementing such changes.
3 Permission to use the Service; reservation of rights.
By agreeing to these Terms of Service, you are granted a limited, non-exclusive, non-transferable, non-sublicensable right to enter, access and use the Service solely for personal, non-commercial use. All rights not expressly granted to you in these Terms of Service are reserved by the Company and its licensors, as applicable. You agree that this permission is for your personal, non-commercial use and that no one other than you will use the Service. You have no rights to copy or reproduce in whole or in part any portion of the Service, including without limitation, the Onparle Content. Other than the limited license granted in Section 2 ("Permission to Use the Service; Reservation of Right"), you have no other right, title or interest in the Service. You understand and acknowledge that, in all circumstances, your rights with respect to the Service shall be limited by applicable copyright or intellectual property laws and these Terms of Service.
4. Description of the Service.
Intellectual and industrial property
All the contents of the Web Site, including but not limited to, texts, photographs, graphics, images, icons, technology, software, links and other audiovisual or sound contents, as well as its graphic design and source codes (hereinafter, the 'Contents'), are the intellectual property of OnParle or third parties, and none of the exploitation rights over them beyond what is strictly necessary for the correct use of the Web Site may be understood to have been granted to the User.
The trademarks, trade names or distinctive signs are owned by OnParle or third parties, without it being understood that access to the Web Site attributes any right over the aforementioned trademarks, trade names and/or distinctive signs.
Prohibited Conduct. You will not use the Service to transmit, display, perform or otherwise make available messages, content or materials that are unlawful, obscene, threatening, unsolicited bulk or "spam," defamatory, invasive of privacy, or that violate or infringe copyrights, trademarks, patents, trade secrets and other intellectual property rights, rights of privacy or publicity, communications regulations or statutes, or any other laws, including, without limitation, libel, harassment, obscenity and pornography laws; constitute political campaigning or sales or marketing solicitations or contain computer viruses or other computer code intended to interfere with the functionality of computer systems, or otherwise harm minors. You agree not to interrupt or attempt to interrupt the operation or the Service in any way. During the Course, students are expected to conduct themselves in an appropriate and respectful manner, with a high standard of education and career progression for others. Any violation hereof shall be subject to such review and appropriate action as the Company may decide to take, at its sole discretion, including the right to terminate the Service in accordance with Section 14 hereof. In addition, you may not use a false e-mail address or otherwise mislead other members as to your identity or the origin of a message or content.
5. Terms of use of the Web Site
5.1.1 Account Creation and Registration Information
You may browse, preview and search within the Service without opening an Onparle Account or providing registration information. However, for any other use of the Service and access to Onparle content, you must open an account and provide registration information to the Company.
The User agrees to make proper use of the Website in accordance with the Law and this Legal Notice. The User shall be liable to OnParle or third parties for any damages that may be caused as a result of a breach of this obligation.
It is expressly prohibited the use of the Web Site for purposes harmful to property or interests of OnParle or third parties or otherwise overload, damage or disable the networks, servers and other computer equipment ("hardware") or products and computer applications ("software") of OnParle or third parties.
You may access OnParle content as many times as you wish, provided that you have subscribed to the Service. You are also authorized to transfer Onparle podcasts and class recordings to certain portable devices for personal, non-commercial use. You agree not to copy, reproduce, distribute or transfer such content to any other media or device, or distribute or transfer it to any other person or third party.
6 Additional software and hardware terms.
Please note that there may be separate end user license agreements and terms of service that you must agree to for hardware and software that you use in connection with the Service, or that may interact with the Service. Your refusal to accept the terms of such agreements would limit your ability to fully utilize the Service. In addition, the Service only works with compatible devices.
7 Contents
The User agrees to use the Contents in accordance with the Law and this Legal Notice, the User in accordance with the current legislation shall refrain from:
Reproduce, copy, distribute, make available, publicly communicate, transform or modify the Contents except in cases authorized by law or expressly consented to by OnParle or by whoever holds the ownership of the exploitation rights as the case may be.
Reproduce or copy for private use the Contents that can be considered as Software or Data Base in accordance with the current legislation on intellectual property, as well as its public communication or making available to third parties when these acts necessarily imply the reproduction on the part of the User or of a third party.
Extract and/or reuse all or a substantial part of the Contents of the Website, as well as the databases that OnParle makes available to the Users.
Our image providers (Shutterstock and Freepick) are also responsible for the graphic and intellectual content (texts, image bank photographs, infographics).
8 Promotions
The Company and certain third parties may, from time to time, place advertisements or present promotional offers and materials on or through the Service. Your participation in any promotion or offer is subject to the applicable rules related to the promotion. Your dealings with other entities or third parties, as well as your participation in third party promotions or offers that are advertised or appear on the Service are solely between you and such third party. YOU AGREE THAT THE COMPANY SHALL NOT BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY SORT INCURRED AS THE RESULT OF ANY SUCH DEALINGS OR THE PRESENCE OF SUCH ADVERTISERS ON THE SERVICE.
Discounts are not cumulative, if a user already has a discount can not apply to another.
The restrictions of the payment agreements with are defined in paragraph 12.3 of this document.
9 Data collection forms
Without prejudice to the provisions of clause 4 of this Legal Notice, the use of certain services or requests addressed to OnParle are conditioned to the previous fulfillment of the corresponding User registration.
All information provided by the User through the forms on the Website for the above purposes or any other must be truthful. To these effects, the User guarantees the authenticity of all those data that he communicates and will maintain the information facilitated to OnParle perfectly updated so that it responds, at all times, to the real situation of the User. It will be the User, in any case, the only responsible for false or inaccurate statements made and the damages caused to OnParle or third parties for the information provided.
10 Protection of personal data
The data collected through the data collection forms on the Website will be incorporated into an automated personal data file for which OnParle is responsible. This entity will treat the data confidentially and exclusively for the purpose of managing the relationship with its customers and promote the activities of OnParle. The User accepts that through registration on the Website, OnParle collects personal data, which are not transferred to third parties without the User's knowledge. Likewise, OnParle will cancel, delete and / or block the data when they are inaccurate, incomplete or no longer necessary or relevant for their purpose, in accordance with the provisions of the legislation on data protection.
By clicking the "send" button on the corresponding form, the User expressly consents that his/her data may be used for sending commercial communications by e-mail or by any other means.
In the data collection forms, the fields marked with an asterisk are mandatory so that if the User does not provide the corresponding data, OnParle may at its sole discretion deny the corresponding service.
The User may revoke the consent given and exercise the rights of access, rectification, cancellation and opposition by contacting the address indicated in clause 1 and visibly indicating the specific right being exercised.
OnParle adopts the security levels. Notwithstanding the above, technical security in a medium such as the Internet is not impregnable and there may be leaks due to malicious actions of third parties.
11 Legislation
This Legal Notice is governed in each and every one of its ends by Colombian law.

The Website uses cookies. 12 Conditions of Use
12.1 Modifications to the Terms of Use
OnParle may modify the Terms of Use contained herein, at its free choice and at any time and they will be in force once they have been published on the Web Site.
The User agrees to periodically review this section to be informed of such modifications and each new access of the user to the page will be considered a tacit acceptance of the new conditions.
12.2 Online classes.
The class packages have an expiration date of 1 year, during this period the student can make use of the remaining classes. After this period the contract will be terminated and there will be no place for any claim or refund of money by the COMPANY. Any change in class schedules must be notified with the required time according to the case, if this is not fulfilled, the class will be charged as seen since both the resources and the teacher were available at that time.
12.3 Payment
The payment of the courses must be in advance. The student must have working hours (paid in advance) to see the class, if the student does not have working hours must purchase a new package of hours (level or sublevel) to continue with a new class. The payment agreements made between the COMPANY and THE USER must be fulfilled in full and in the agreed term of time, if this does not happen any discount made will be revoked and the balance must be paid at its price without discount.
At the time of payment a payment receipt will be sent, by default the invoicing will be made month by month according to the hours consumed by the USER or the invoice can be made for the total amount paid by mutual agreement with the customer upon request.
12.4 Returns
The student may request a partial refund of the remaining balance (business hours paid) within the first 7 days after the payment is made. In the event that this condition is met, the partial refund will be considered favorable minus the classes seen and administrative expenses equivalent to 15 percent in packages of classes less than 16 hours and 5 percent in packages for sub-levels and full levels and such refund will be made within the following 30 business days, otherwise, if the claim is later than the stipulated time (7 days) there will be no refund, but the student can continue to use his/her class hours normally or assign them to another person during the working period (1 year).
12.5 Recordings
In the personalized courses and in pairs all our classes can be recorded, these recordings are additions to the service at no cost and therefore Onparle is not responsible for recordings that have not been recorded either for reasons inherent to the platform or external, in most cases the students are who must record their classes, in the case that the student forgets to record them Onparle is not responsible for these recordings.
You can download the recordings to review the topics viewed, it is strictly forbidden to distribute or sell the videos whether they are recordings of the classes or any video of our YouTube channel or other social networks or any other content of Onparle for commercial or other unauthorized use.
Class recordings cannot be made in group courses.
Classes are recorded for 8 days (1 week) and then deleted to free up space on our server.
In order to preserve the confidentiality of student and teacher data and in order to protect the right to personal privacy, students and teachers may not sell, promote, upload to the Internet or share on social networks any of the class recordings without prior consent and authorization from Onparle.
12.6 Schedules
Students choose the schedules in which they wish to have personalized classes or in pairs, at the time of sending these schedules they commit to attend punctually, they must be connected on the platform and in the virtual classroom 5 minutes before the beginning of the class. In the group courses the schedules and weekly intensity will be those proposed by Onparle and the student will not be able to request changes in schedules or intensity.
12.7 Postponement or rescheduling of classes Online
In the individual and couple classes the student can postpone the class, in case you can not take the class on the scheduled day and time you can let us know with 3 hours (three hours) in advance to postpone and reschedule, if you notify us with less time, you will be counted one hour of class as seen.
In group classes or conversation workshops, the student will not be able to postpone the class. The dates and times are fixed, designated by Onparle and announced on our website, there is no room for cancellations or rescheduling of classes, if the student does not attend that class is assumed as seen and the value of the class will be debited.
In group courses the student cannot postpone classes, if he/she does not attend the class the class hours will be debited from his/her acquired hours.
12.8 Non-attendance and class cancellations
For personalized and partner courses the teacher will log in at the scheduled time and wait for you for 15 minutes, if you do not log in during this period of time, the student will be counted as non-attendance and the class will be counted as seen, the total duration of the class will be debited from your available hours and you will have to watch the topics at home or buy additional hours to unblock that class. If you are late for your class and notify the teacher before the class starts or before the 15 minute waiting period, the teacher will wait for you but will finish the class at the stipulated time.
If you cancel with less than 3 hours notice, 1 hour will be debited from your available hours.
If you give less notice, one hour of class will be counted as seen or you can notify the teacher that you will be late and the class will end at the stipulated time without the possibility of making up the lost minutes.
If your class is shared with several teachers and you must cancel or reschedule, you must give at least 3 days notice and one hour will be counted as class time.
In group courses the student cannot cancel classes, if he/she does not attend the class the class hours will be debited from his/her purchased hours.
12.9 Class Cancellation
If you cancel more than two classes in a row, you will assume one hour of class time as seen because at the beginning of the process we will schedule a teacher who will be available to give you your class.
In case of domestic calamity, the hour will not be counted and will be rescheduled.
If your class is shared with several teachers and you must cancel or reschedule, you must give 3 days notice. If you do not do so, one hour will be counted as a class if you do not give the required notice.
12.10 Group courses
Onparle's group courses are made up of a maximum of 4 students and a minimum of 3 students required for the opening of group courses. In group courses Onparle does not guarantee the continuity of the course for the following levels as it depends on the number of students enrolled, in case there are 2 students left, they can continue with the current rate for couples.
12.11 Schedule changes
If you wish to change the schedule of any of your classes you must let us know 1 week (8 days) in advance to schedule the teacher. At any time you can increase or reduce the weekly intensity as long as you let us know with the required anticipation.
In group courses the schedules and weekly intensity will be those proposed by Onparle and the student will not be able to request changes in schedules or intensity.
12.12 Technical problems
If technical problems occur due to general failure of our platform(s) that prevent the development of the class in its entirety, classes will be postponed and a notification will be sent when the failures are resolved and no charge will be generated to the USER, if the connection failures are by the teacher, the teacher will recover the time you have lost, but if the problems are due to failures in the USER's (student's) Internet connection that prevent his/her connection or continuity in the platform or that generate continuous interruptions, the class will be assumed as seen and the value of these hours will be debited from your balance, and you will then have to review the topics at home without recovering the time lost for such reasons.
In case of unforeseen circumstances due to the teacher's absence, the class will be postponed at no additional cost to you.

12.13 Computer changes
If you change your computer or make an upgrade, please let us know at least 24 hours in advance, our technical team is ready to assist you and make the configuration required for its proper functioning.
12.14 Bandwidth
For the optimal functioning of the platform you must have a minimum of 10 Mb of internet per user (for classes in pairs with 2 computers from the same place it must be double 20 Mb).
12.15 Learning Times
Learning times for each individual to acquire a level may vary according to availability, skills, abilities and commitment of the student.
13 Technical requirements
These technical requirements must be taken into account for the correct development of the classes and operation of the platform.

14 Termination of service
14.1 Indemnification.
You agree to defend, indemnify and hold the Company harmless from and against any and all claims, losses, damages, liabilities, deficiencies, judgments, liens, fines, and other expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Service, or any breach by you of these Terms of Service, and you agree to reimburse the Company, upon request, for any losses, costs or expenses incurred by you on account thereof.
14.2 Term; termination.
The term of these Terms of Service will remain in effect until terminated as described herein. These Terms of Service and your rights to access, download and use the Service are subject to immediate termination, without notice, (a) if you breach (or the Company reasonably suspects that you have breached) any provision of these Terms of Service, or (b) upon the Company's discontinuance of dissemination or support of the Service. If such termination without notice is expressly prohibited by applicable law, then such termination will occur upon notice of any such breach. Upon termination, you must stop using the Service, completely. If the Company terminates these Terms of Service, or suspends your Onparle Account for any of the reasons set forth in these Terms of Service, the Company will have no obligation or liability to you and will not refund any amounts previously paid by you.

10 Protection of personal data
The data collected through the data collection forms on the Website will be incorporated into an automated personal data file for which OnParle is responsible. This entity will treat the data confidentially and exclusively for the purpose of managing the relationship with its customers and promote the activities of OnParle. The User accepts that through registration on the Website, OnParle collects personal data, which will not be disclosed to third parties without his knowledge. Likewise, OnParle will cancel, delete and/or block the data when they are inaccurate, incomplete or no longer necessary or relevant for their purpose, in accordance with the provisions of the legislation on data protection.
By clicking the "send" button on the corresponding form, the User expressly consents that his/her data may be used for sending commercial communications by e-mail or by any other means.
In the data collection forms, the fields marked with an asterisk are mandatory so that if the User does not provide the corresponding data, OnParle may at its sole discretion deny the corresponding service.
The User may revoke the consent given and exercise the rights of access, rectification, cancellation and opposition by contacting the address indicated in clause 1 and visibly indicating the specific right being exercised.
OnParle adopts the security levels. Notwithstanding the above, technical security in a medium such as the Internet is not impregnable and there may be leaks due to malicious actions of third parties.

12 Conditions of Use
12.1 Modifications to the Terms of Use
OnParle may modify the Terms of Use contained herein, at its free choice and at any time and they will be in force once they have been published on the Web Site.
The User agrees to periodically review this section to be informed of such modifications and each new access of the user to the page will be considered a tacit acceptance of the new conditions.
12.2 Online classes.
The class packages have an expiration date of 1 year, during this period the student can make use of the remaining classes. After this period the contract will be terminated and there will be no place for any claim or refund of money by the COMPANY. Any change in class schedules must be notified with the required time according to the case, if this is not fulfilled, the class will be charged as seen since both the resources and the teacher were available at that time.
12.3 Payment
The payment of the courses must be in advance. The student must have working hours (paid in advance) to see the class, if the student does not have working hours must purchase a new package of hours (level or sublevel) to continue with a new class. The payment agreements made between the COMPANY and THE USER must be fulfilled in full and in the agreed term of time, if this does not happen any discount made will be revoked and the balance must be paid at its price without discount.
12.4 Returns
The student may request a partial refund of the remaining balance (business hours paid) within the first 7 days after the payment is made. In the event that this condition is met, the partial refund will be considered favorable minus the classes seen and administrative expenses equivalent to 15 percent in packages of classes less than 16 hours and 5 percent in packages for sub-levels and full levels and such refund will be made within the following 30 business days, otherwise if the claim is later than the stipulated time (7 days) there will be no refund, but the student can continue to use his/her class hours normally during the working period.
12.5 Recordings
All our classes can be recorded, these recordings are additions to the Service at no cost and therefore Onparle is not responsible for recordings that have not been recorded either for reasons inherent to the platform or external, in most cases the students are who must record their classes, in the case that the student forgets to record them Onparle is not responsible for these recordings.
You can download the recordings to review the topics seen, it is strictly forbidden to distribute or sell the videos whether they are recordings of the classes or any video of our youtube channel or other social networks or any other content of Onparle for commercial use.
The classes are recorded for 8 days (1 week) and then will be deleted to free up space on our server.
Seeking the reserve and confidentiality of student and teacher data and for the right to personal privacy students and teachers can not sell, promote, upload to the Internet, share on social networks, any of the recordings of the classes without prior consent and authorization of Onparle.
12.6 Schedules
Students choose the times they wish to have personalized classes, at the time of submitting these schedules they commit to attend punctually, they must be connected to the platform and the virtual classroom 5 minutes before the start of the class.
12.7 Postponement or rescheduling of classes Online
In individual classes the student can postpone the class, in case you cannot take the class on the scheduled day and time you can let us know with 3 hours (three hours) in advance to postpone it and reschedule it, if you give us less time, one hour of class will be counted as seen.
In group classes or conversation workshops, the student cannot postpone the class; non-attendance will result in the payment of the class fee.
12.8 Non-attendance and class cancellations
The teacher will log in at the scheduled time and wait for you for 15 minutes, if you do not log in during this time, the student will be counted as a non-attendance and the class will be counted as seen, the total duration of the class will be debited from your available hours and you will have to watch the topics at home or buy additional hours to clear that class. If you are late for your class and notify the teacher before the class starts or before the 15 minute waiting period, the teacher will wait for you but will finish the class at the stipulated time.
If you cancel with less than 3 hours notice, 1 hour will be debited from your available hours.
If you give less notice, one hour of class will be counted as seen or you can notify the teacher that you will be late and the class will end at the stipulated time without the possibility of making up the lost minutes.
If your class is shared with several teachers and you must cancel or reschedule, you must give at least 3 days notice and one hour will be counted as class time.
12.9 Class Cancellation
If you cancel more than two classes in a row, you will assume one hour of class time as seen because at the beginning of the process we will schedule a teacher who will be available to give you your class.
In case of domestic calamity, the hour will not be counted and will be rescheduled.
If your class is shared with several teachers and you must cancel or reschedule it, you must give 3 days notice. If you do not do so, one hour will be counted as a class if you do not give the required notice.
12.10 Schedule changes
If you wish to change the schedule of any of your classes you must let us know 1 week (8 days) in advance to schedule the teacher. At any time you can increase or reduce the weekly intensity as long as you let us know with the required anticipation.
12.11 Technical problems
If technical problems occur due to general failure of our platform, classes will be postponed and a notification will be sent when the failures are resolved, no charge will be generated to the user, if the connection failures are caused by the teacher, the teacher will recover the time you have lost, but if the problems are caused by failures in the Internet connection of the user (student) that prevent their connection or continuity on the platform or that continuously generate interruptions, the class is assumed as seen and the value of these hours will be debited from your balance, and you must then review the topics at home without recovery of the time lost for such reasons.

12.12 Computer changes
If you change your computer or make an upgrade, please let us know at least 24 hours in advance, our technical team is ready to assist you and make the configuration required for its proper functioning.
12.13 Bandwidth
For the optimal functioning of the platform you must have a minimum of 10 Mb of internet per user (for partner classes with 2 computers from the same place it must be double).
13 Technical requirements
These technical requirements must be taken into account for the correct development of the classes and operation of the platform.

14 Termination of service
14.1 Indemnification.
You agree to defend, indemnify and hold the Company harmless from and against any and all claims, losses, damages, liabilities, deficiencies, judgments, liens, fines, and other expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Service, or any breach by you of these Terms of Service, and agree to reimburse the Company, upon request, for any losses, costs or expenses incurred by you as a result thereof.
In the event of unforeseen technical issues related to the platform(s) that prevent the class from being viewed in its entirety or due to teacher non-attendance, the class will be postponed at no additional cost to You.
14.2 Term; termination.
The term of these Terms of Service will remain in effect until terminated as described herein. These Terms of Service and your rights to access, download and use the Service are subject to immediate termination, without notice, (a) if you breach (or the Company reasonably suspects that you have breached) any provision of these Terms of Service, or (b) upon the Company's discontinuance of dissemination or support of the Service. If such termination without notice is expressly prohibited by applicable law, then such termination will occur upon notice of any such breach. Upon termination, you must stop using the Service, completely. If the Company terminates these Terms of Service, or suspends your Onparle Account for any of the reasons set forth in these Terms of Service, the Company will have no obligation or liability to you and will not refund any amounts previously paid by you.
